Terms of Use

1. Agreement and eligibility

These Terms of Use are an agreement between you and Sebastian Trumbo ("Gatekey," "we," "us") for using the Gatekey iPhone app (the "app") and the website getgatekeyapp.com (the "site"). By using either, you agree to these terms. If you don't agree, please don't use Gatekey.

You must be at least 13 years old to use Gatekey. If you're under the age of majority where you live, you need a parent's or guardian's permission.

2. What Gatekey does

Gatekey finds the pieces of clothing in a photo you scan and suggests products that match them, at different price levels. Matches are suggestions. They may not be exact, and we don't guarantee that any product will match the original. Stores set their own prices, stock and availability, which can change at any time, so what you see in Gatekey may differ from the store's site.

3. Purchases happen on stores' sites

When you choose a product, Gatekey sends you to the store's website. Any purchase happens there, under that store's terms, prices and policies. We are not the seller and are not a party to your purchase. Questions about orders, payments, shipping, returns or the products themselves go to the store.

4. Affiliate relationships

We may earn a commission when you buy through our links. Some links are affiliate links run through affiliate networks and partner programs. Using them doesn't change the price you pay.

5. Acceptable use

You agree not to:

• scrape, crawl or collect data from the app or the site by automated means;
• copy, modify, decompile, reverse engineer or try to extract the source code of the app, except where the law allows it;
• interfere with or disrupt Gatekey, its servers or its security, or try to get around any limits or protections;
• use Gatekey for anything unlawful, or to scan content you don't have the right to use;
• misuse Gatekey in any other way, including reselling or repackaging its results.

6. Your content

Photos you scan stay yours. You give us permission to process the cut-outs the app makes from them only to find matches for you, as described in our Privacy Policy. You're responsible for making sure you have the right to use the photos you scan.

7. Intellectual property

Gatekey, including the app, the site, our name, logo and design, belongs to Sebastian Trumbo and is protected by intellectual property laws. We give you a personal, non-exclusive, non-transferable, revocable license to use the app for your own non-commercial use, in line with these terms and the App Store's terms. Product names, images and trademarks shown in results belong to their owners.

8. Disclaimers and limitation of liability

Gatekey is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We don't promise that Gatekey will always be available, error-free or accurate.

To the fullest extent the law allows, Sebastian Trumbo is not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data or goodwill, arising from your use of Gatekey or from any purchase you make from a store. Our total liability for any claim relating to Gatekey is limited to the greater of $100 or the amount you paid us in the 12 months before the claim arose. Some places don't allow these limits, so they may not all apply to you.

9. Ending access and changes

You can stop using Gatekey at any time by deleting the app. We may suspend or end your access if you break these terms, and we may change or stop offering any part of Gatekey.

We may update these terms. When we do, we'll change the effective date at the top, and for significant changes we'll let you know in the app or on this site. If you keep using Gatekey after an update, you accept the new terms.

10. Governing law

These terms are governed by the laws of Florida, United States, without regard to its conflict-of-law rules. Any dispute will be handled in the state or federal courts located in Florida, unless the law where you live gives you the right to bring it elsewhere.
